To enhance workplace conditions and safeguard the rights of pregnant female employees, and pursuant to the recommendation of the Cambodian Prime Minister, on 7 February 2025 the Ministry of Labor and Vocational Training (“MLVT”) issued an Instruction on Special Protection for Pregnant Female Employees. This instruction aims to ensure the well-being of pregnant female employees and improve their working conditions.
Key requirements imposed on employers under this Instruction are as follows:
- No discrimination in job opportunities, contract renewal, wage increment, and benefits.
- Total wage to be entitled during maternity leaves shall be provided before maternity leave;
- No contract suspension within 9 months at post-maternity leave, except in cases where the suspension applies to any specific part of enterprise or all employees;
- Encouraging automatic renewal of contract for pregnant employees or within 1 year after their childbirth;
- No dismissal of pregnant employees or within 1 year after their childbirth, except for serious misconduct; and
- Any dismissal requires an approval form labor inspector.
The MVLT has reinforced protections for pregnant female employees, ensuring job security, wage entitlements, and protection against unfair dismissal. Employers must strictly comply with these regulations to promote fair and inclusive workplaces and avoid penalties.
