Tax Update: Postponement of the Capital Gains Tax Implementation

On 30 October 2025, the General Department of Taxation (“GDT”) under the Ministry of Economy and Finance issued Notification No. 34236 GDT announcing the postponement of the implementation of Prakas No. 496 MEF.Prk, dated 18 July 2025, concerning the Capital Gains Tax (“CGT Prakas”).
The Key Highlights of this Notification are:

• The Royal Government, led by Samdech Moha Thipadei Hun Manet, has approved the postponement of the CGT implementation.
• The new effective implementation date for the CGT Prakas will be the 1st January 2026 for all the six categories of assets, namely investment assets including shares, IP, leases, goodwill, foreign currency, and Immovable Properties.

There have been multiple postponements in the implementation of capital gains tax regulations, primarily attributed to economic uncertainties following the COVID-19 pandemic. Nevertheless, the most recent delay appears to reflect a deliberate effort by the GDT to ensure that both taxpayers and the tax administration are sufficiently prepared for effective and consistent implementation. It is believed that the authorities have placed particular emphasis on establishing a clear and uniform methodology for determining the cost basis of each capital asset, a crucial element in calculating capital gains accurately and fairly. Whether there will be further postponements in the future remains to be seen.
