Tax Update: Prakas No. 632 MEF.BrK on Implementation of Tariff Rates on Goods Imported from the United States

On 8 August 2025, the Ministry of Economy and Finance (“MEF”) of the Kingdom of Cambodia issued Prakas No. 632 MEF.Brk (“Prakas”), providing detailed procedures for implementing the 0% tariff rate on goods imported from the United States, as mandated by Sub-Decree No. 139 ANK.BK (“Sub-Decree”) issued on the same date. This Prakas follows up on the Sub-Decree, which established a preferential customs tariff policy for qualifying U.S.-origin goods, signaling Cambodia’s continued commitment to fostering bilateral trade with the United States.

Key highlights of the Prakas:

  • Scope and effective date: The 0% tariff rate apply to new goods originating in the United States and shipped directly from the United States to Cambodia, with used goods expressly excluded. The preferential rate applies only to qualifying goods loaded in the United States on or after 8 August 2025.
  • Proof of origin: Importers must declare the U.S. origin of goods in accordance with the format and procedures prescribed by the General Department of Customs and Excise of Cambodia (“GDCE”).
  • Procedural oversight: The GDCE is tasked with issuing further instructions to ensure effective implementation and compliance.

Commentary

The Prakas provides further procedural clarity to the Sub-Decree, enabling importers to navigate the 0% tariff regime effectively. While it confirms the eligibility criteria and effective date, the practical application will depend on the GDCE’s forthcoming instructions, which are expected to address documentary requirements, verification processes, and any post-clearance audit measures. Importers intending to benefit from the 0% tariff rate are recommended to:

  • ensure the imported goods meet U.S. origin criteria as defined by the GDCE.
  • maintain accurate and complete documentation to support origin claims.
  • stay informed about additional GDCE instructions to ensure compliance with evolving requirements.

The introduction of this Prakas, alongside the Sub-Decree, is expected to enhance Cambodia’s trade competitiveness with the U.S. market. However, businesses should remain vigilant for any sector-specific restrictions or non-tariff barriers that may emerge. Proactive preparation and robust compliance measures will be critical to leveraging the full potential of this tariff-free regime.
